This Sweepstakes is governed exclusively by the laws of the United States. You are not authorized to participate in the Sweepstakes if you are not located within Arizona, Illinois, Missouri, and Nevada (the “Applicable States”).

 

1. DATES OF SWEEPSTAKES. Sweepstakes begins at 12:00 a.m. PT on June 20, 2025 and ends at 11:59 p.m. PT on September 1, 2025 (the “Sweepstakes Period”).

 

2. ELIGIBILITY. Sweepstakes is open only to legal residents of Arizona, Illinois, Missouri,  and Nevada, who are twenty-one (21) years of age or older as of the date of entry (the “Entrant”). Void outside of the Applicable States, and where prohibited, taxed or restricted by law. Entrants must be able to travel on the date(s) specified below in order to be eligible to win. Officers, directors, managers, and employees of Mint Marketing, LLC (the “Sponsor”), and each of its respective parents, subsidiaries, affiliates and related companies and their respective advertising and promotion agencies, consultants and agents, as well as immediate family members and/or those living in the same household of each such person, and any others engaged in the development, production, execution or distribution of this Sweepstakes (collectively the “Sweepstakes Entities”) are not eligible to participate. “Immediate family member” shall be deemed to mean husband, wife, children, mother, father, sister, sister in-law, brother or brother in-law. Sweepstakes may only be entered in or from the Applicable States. All federal, state and local laws and regulations apply. This sweepstakes is not active in the state of Florida or Massachusetts.

 

3. HOW TO ENTER. There are two (2) ways to enter:

 

(i) PURCHASE: Entrants making a purchase at a participating “Mint Cannabis” retail location between the Sweepstakes Period of at least Fifty and 00/100 US Dollars ($50.00) will receive an entry card. For every Fifty and 00/100 US Dollars ($50.00) spent by an Entrant, they will receive an additional entry card. Those who receive an entry card may complete the online entry form to receive one (1) entry into the Sweepstakes. Each entry card will include a unique pin code necessary for entry into the Sweepstakes. Upon receipt of the entry card, Entrant must follow the link accessible through the QR card (the “Entry Website”) and enter the unique pin code found on the entry card. Then, complete the entry form in its entirety and click the “Submit” button. The entry form in its entirety to include first name, last name, street address, city, state, zip, phone number, and email address (if available) and click “Continue”. The entry form must be completed in order to be eligible to win. Then, complete the check boxes and click “Submit” to receive one (1) entry into the Sweepstakes. Entries must be received by 11:59 p.m. PT on September 1, 2025.

 (ii) TRANSFERRED ENTRIES: Eligible Entries that were received by Sponsor after March 7, 2025 will be automatically entered into this Sweepstakes.

(iii) WRITE-IN: To enter without making a purchase, legibly handwrite your complete name, mailing address, phone number, email address, and date of birth and mail a self-addressed, stamped envelope, that is no smaller than 3 ½ x 5 inches and no larger than 8 ½ x 11 inches, with proper postage to: Mint Sweepstakes, 5210 S. Priest Dr. Guadalupe, Arizona 85283. You must also include a legible copy of your passport, state issued ID, or driver’s license. Upon receipt, Sponsor will mail you an entry card where the Entrant can enter pursuant to the instructions, above. There is a limit of one (1) write-in entry per envelope, per day. Multiple entries submitted or completed by anyone other than the Entrant are void. No mechanical reproductions will be accepted. Write-in entries must contain all entry fields and other information outlined above; otherwise, they are void and will not be eligible to win.

 

Regardless of the entry method used to enter the Sweepstakes, there is a limit of two-hundred (200) entries per Entrant for the entire Sweepstakes Period. Any attempt by an Entrant to obtain more than the stated number of entries by using multiple/different identities, and/or any other methods will void that Entrant’s entry and that Entrant may be disqualified from the Sweepstakes. Entries submitted by anyone other than the Entrant are void. In case of dispute as to the identity of any Entrant, entry will be declared made by the registered name and address on such entry. Any potential prize winner may be requested to provide Sponsor with proof that such person is the prize winner.

 

Neither Sponsor nor any Sweepstakes Entity is responsible for any entry that is lost, late, illegible, stolen, mutilated, incomplete, invalid, unintelligible, postage-due, misdirected or undeliverable, whether due to system errors, omissions, interruption, deletions, defects, delay in operations or transmissions, theft or destruction or failures, faulty transmissions or other telecommunications malfunctions, human error, entries not received resulting from any hardware or software failures of any kind, lost or unavailable network connections, failed, incomplete or garbled computer or telephone transmissions, typographical or system errors and failures, faulty transmissions, technical malfunctions, or otherwise. Only fully completed entries are eligible. Proof of submission will not be deemed to be proof of receipt by Sponsor or Sweepstakes Entity.

 

4. DRAWING/ODDS. On or about September 8, 2025, potential prize winners will be selected in a random drawing from the eligible entries received by the Sponsor Representative, as set forth herein. Odds of winning depend on the number of eligible entries received for the Sweepstakes. By entering the Sweepstakes, Entrants fully and unconditionally agree to be bound by these Official Rules and the decisions of the Sponsor and Sweepstakes Entities, which will be final and binding in all matters relating to the Sweepstakes.

 

To be eligible to receive a prize, all Entrants must have an address on file with the Sponsor or have provided an address when prompted at the time of entry. In the event that an Entrant has an incomplete address, the Entrant will be disqualified and an alternate prize winner will be selected in a random drawing.

 

5. PRIZES.

 

FINALIST PRIZES: Five (5) finalist prizes will be awarded, as set forth, below (each a “Prize”). Finalist Prizes will be drawn from a pool of entries received based upon Applicable State as follows: two (2) from Arizona entries; one (1) from Illinois entries; one (1) from Missouri entries; and one (1) from Nevada entries (each a “Potential Finalist” and collectively the “Potential Finalists”).

 

The Prize consists of the following package: Each Potential Finalist from Illinois, Missouri, and Nevada and one guest (each) (“Non-Arizona Participants”) will be provided airfare from the nearest international airport to the Potential Finalist’s home address to Phoenix Sky Harbor Airport on 11/07, 2025. Each Arizona Potential Finalist and one (1) guest (“Arizona Participants”) will be transported from the address from a single address to hotel accommodations of Sponsor’s choosing (“Hotel Accommodation”) on 11/07, 2025. Each Potential Finalist and the guest of the Potential Finalist must be twenty-one (21) years of age or older as of June 1, 2025. Each Non-Arizona Participants will be provided transportation from Phoenix Sky Harbor Airport to the Hotel Accommodation. The Potential Finalist and guest will receive two-night paid accommodations at the Hotel Accommodation (the nights of 11/07/2025 and 11/08, 2025). The Potential Finalist and their guest will be invited to a dinner hosted by Sponsor on 11/07, 2025. On 11/08, 2025, the Potential Finalist will be invited to participate in a hole-in-one golf shootout (“Golf Shootout”). The Potential Finalist’s guest will not be able to participate in the Golf Shootout. All other expenses will be the responsibility of the Potential Finalist and/or its guest.

 The Potential Finalist and guest will be transported from the Hotel Accommodation to the location of the Golf Shootout on 11/08, 2025. Spectators will be invited to watch the Golf Shootout. The rules of the Golf Shootout will be as follows: 1) Each Potential Finalist will be given one opportunity to hit a hole-in-one from a distance of 175 yards on a par three (3) golf hole specified by Sponsor; 2) The Tee area will be marked by Sponsor and the Potential Finalist may not take a shot from in front of the Tee area; 3) The hole-in-one must be accomplished as defined by the United States Golf Association Rules of Golf; 4) The Potential Finalist must wait until the Sponsor representative gives them approval to take their shot to allow for videotaping of the complete shot; and 5) the Potential Finalist must not play the hole the Golf Shootout takes place in the forty-eight (48) hours before the Golf Shootout.

If the Potential Finalist makes a hole-in-one pursuant to the above rules, the Potential Finalist will receive a prize of One Million and 00/100 US Dollars ($1,000,000.00) (the “Maximum Prize”). The Prize will be paid by Obsidian Specialty Insurance (“Insurer”) Company pursuant to its “Prize Award Installment Endorsement” which can be viewed here. Any action taken by the Potential Finalist that voids payment by Insurer will void Sponsor’s liability and/or obligation to the Potential Finalist in the event of a hole-in-one shot made. More than one Potential Finalist may win the Maximum Prize in the event of multiple hole-in-one shots made.

If there are no hole-in-one shots made by the Potential Finalists, the finalist with the shot that is closest to the pin, measured by distance from the final resting place of the Potential Finalist’s ball to the center of the hole, will win a prize of Five Thousand and 00/100 US Dollars ($5,000.00) (“Consolation Prize”). If more than one Finalist’s shots are an equal distance from the center of the hole, the winner of the Consolation Prize will be selected via flipping a coin.

Each Finalist and guest will be required to fill out a Waiver of Liability Form in substantially the same form as shown here: ___[insert link]___ (“Waiver of Liability”). Sponsor reserves its right to amend the Waiver of Liability prior to execution. Finalist and guest will be required to return a fully executed Waiver of Liability within seven (7) days of notification of their finalist drawing. If the Finalist is unable to attend on the dates specified herein, the Finalist may assign their participation in the Golf Shootout, and the finalist benefits set forth in this Paragraph 5, to another individual who is twenty-one (21) years of age or older as of June 1, 2025 (each an “Assignee”). A Finalist must notify Sponsor of the assignment within three (3) days of notification of their finalist drawing. The Assignee (and guest if applicable) will need to execute the Waiver of Liability within three (3) days of notification of the assignment. Any assignment must occur within seven (7) days of the Finalist’s notification of their finalist drawing.

Should a Finalist fail to respond to the Sponsor’s communications and attempts to obtain information and the Waiver of Liability within seven (7) days of the first attempted notification, or fail to reasonably respond to any requests for information thereafter, may result in the waiver of the Prize. In such event, Sponsor reserves the right to award an additional Prize to a new Potential Finalist

6. PRIZE RESTRICTIONS: Limit of one (1) prize per person/household. All prizes are non-transferable or assignable (except as set forth above) and no substitutions or cash redemptions; except at Sponsor’s sole discretion or as otherwise provided herein. Each Potential Finalist is solely responsible for all applicable federal, state and local taxes, including taxes imposed on their income. No more than the stated number of prizes set forth in these Official Rules will be awarded. Potential prize winners consent to the use of their name, likeness, biographical information, and voice in advertising worldwide without additional compensation.  A POTENTIAL FINALIST MAY NOT BE ANY PERSON THAT HAS PLAYED IN A PROFESSIONAL GOLF TOURNAMENT IN THE LAST 24 MONTHS.

 

7. NOTIFICATIONS/CLAIMS.

 

GRAND PRIZE:

Potential Finalists will be notified by the Sponsor by email and/or phone on or about September 8th, 2025 (the “Notification”). Grand Prize winners must respond to Notification within three (3) business days of the Notification. In the event the Potential Finalist fails to respond to the Notification within three (3) business days of the Notification or if it is determined by Sponsor, in their sole discretion, that a Potential Finalist is not eligible in accordance with these Official Rules, an alternate Potential Finalist will be selected at random from among the remaining non-winning eligible entries received during the Sweepstakes Period for the specific state the prior ineligible Potential Finalist was selected. The Potential Finalist will be required to sign and return (except where prohibited) an Affidavit of Eligibility and Waiver/Publicity Release and a W-9 tax form (the “Paperwork”) within ten (10) days of the Notification. After verification of the Affidavit, the Sponsor representative will contact the Potential Finalist to book travel as set forth above. Potential Finalists must return the Paperwork within the date and time indicated in the Notification. The Potential Finalist also must provide such information that is necessary to book air travel and accommodations. If a Potential Finalist fails to return the Paperwork within the date and time indicated in the Notification, or is found to be ineligible, or if they do not comply with the Official Rules, such Potential Finalist and their entry will be disqualified and another Potential Finalist will be selected from the remaining eligible entries received. If the Notification is returned as undeliverable, this will result in disqualification and an alternate Potential Finalist will be selected from the remaining eligible entries in the state the prior Potential Finalist was selected from.

 

The value associated with the Prize is taxable as income and each Potential Finalist is solely responsible for any taxes, including, but not limited to all applicable federal, state and local taxes that become due with respect to the value of the Prize. The Sponsor must report the value of the Prize to the Internal Revenue Service in the year the Prize is received by the Potential Finalist and will be reported to the Potential Finalist and the Internal Revenue Service in the form of a Form 1099.

 

No compensation will be provided for any prizes that are not able to be awarded to a prize winner.

 

8. CONDITIONS. This Sweepstakes is conducted in English. In the event of any discrepancy or inconsistency between the terms and conditions of these English Official Rules or other statements contained in any Sweepstakes-related materials, including, but not limited to: any entry form, and/or point of sale, television, print or online advertising; the terms and conditions of these English Official Rules shall prevail, govern and control.

All federal, state and local taxes are the sole responsibility of the Potential Finalists. By participating in this Sweepstakes, Entrants and prize winners agree to be bound by these Official Rules and the decisions of the Sponsor and Sweepstakes Entities, which are final in all respects and not subject to appeal. Notwithstanding the foregoing, the Sponsor reserves the right to amend, update, change, or modify these rules as set forth herein, but also for technical, logistical, or other reasons necessary to conduct the Sweepstakes in the manner intended by the Sponsor.  

Sponsor reserves the right to disqualify permanently from this Sweepstakes any Entrant it believes has violated these Official Rules and verify eligibility of Entrants. Neither Sponsor nor anyone acting on its behalf will enter into any communications with any Entrant regarding this Sweepstakes, except as expressly set forth in these Official Rules. By participating in this Sweepstakes, Entrants, and Potential Finalists release the Sponsor and each and all of the Sweepstakes Entities, from any and all liability, damages or causes of action (however named or described) with respect to or arising out of participation in the Sweepstakes, and/or the receipt or use/misuse of any prize awarded, including, without limitation, liability for personal injury, death or property damage. Failure to comply with these Official Rules may result in disqualification from the Sweepstakes.

Winning a prize constitutes permission for Sponsor and its agencies to use prize winners' names, addresses (city & state), voices and/or likenesses for purposes of advertising, promotion and publicity, for this Sweepstakes only, without further compensation, unless prohibited by law. Sponsor may prohibit an Entrant from participating in the Sweepstakes or winning a prize if, in its sole discretion, it determines that said Entrant is attempting to undermine the legitimate operation of the Sweepstakes by cheating, deception, or other unfair playing practices (including the use of automated quick entry programs) or intending to annoy, abuse, threaten or harass any other Entrants, Sponsor, or Sweepstakes Entities.

If for any reason this Sweepstakes is not able to be conducted as planned, including, but not limited to, by reason of infection by computer virus, bugs, tampering, unauthorized intervention, fraud or any other causes beyond the reasonable control of Sponsor which corrupt or affect the administration, security, fairness, integrity or proper conduct of the Sweepstakes, then Sponsor reserves the right at its sole discretion to cancel, terminate, modify or suspend the Sweepstakes and randomly draw from those entries received up to the cancellation/suspension date to award prizes. CAUTION: ANY ATTEMPT BY A PERSON TO DELIBERATELY DAMAGE OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES MAY BE IN VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK REMEDIES AND DAMAGES (INCLUDING ATTORNEY’S FEES) FROM ANY SUCH PERSON TO THE FULLEST EXTENT OF THE LAW, INCLUDING CRIMINAL PROSECUTION. SPONSOR’S FAILURE TO ENFORCE ANY TERM OF THESE OFFICIAL RULES SHALL NOT CONSTITUTE A WAIVER OF THESE PROVISIONS.

 

9. NO LIABILITY: By participating, Entrants and prize winners agree to release, discharge, indemnify and hold harmless the Sponsor, the Sweepstakes Entities, and each of their respective officers, directors, employees, representatives and agents (collectively, the “Released Parties”) from and against any claims made by any Entrant, prize winner, or any other third parties, related in any way to the operation of this Sweepstakes as well as any other claims, damages or liability due to any injuries, damages or losses to any person (including death) or property of any kind resulting in whole or in part, directly or indirectly, from receipt, acceptance, possession, misuse or use of a prize or participation in any promotion related activity or participation in this Sweepstakes.

 

10. ARBITRATION, GOVERNING LAW, AND WAIVER OF JURY TRIAL AND CLASS ACTION. This Sweepstakes shall be governed by and interpreted in accordance with the laws of the State of Arizona, without giving effect to the principles of conflicts of law of such state. Except where prohibited by law, Entrants and Potential Finalists agree that: (a) any and all disputes, claims and causes of action arising out of or connected with this Sweepstakes and the Official Rules shall be resolved individually, without resort to any form of class action; (b) any and all disputes, claims and causes of action arising out of or connected with this Sweepstakes must be submitted to binding arbitration under the rules of the American Arbitration Association, with one (1) arbitrator selected in accordance with such rules, or by the mutual selection of the Sponsor, or its affiliated entities, and Entrant or Potential Finalist, with the arbitration hearing to take place in Phoenix, Arizona; (c) The prevailing party to the arbitration may enter any final arbitration judgment in any court having jurisdiction thereof; and (d) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Sweepstakes, but in no event attorneys’ or experts’ fees.

 

EACH ENTRANT ACKNOWLEDGES AND AGREE THAT BY PARTICIPATING IN THIS SWEEPSTAKES, THEY ARE KNOWINGLY AND VOLUNTARILY WAIVING ANY RIGHT TO A JURY TRIAL FOR ANY DISPUTE ARISING OUT OF THIS SWEEPSTAKES. EACH ENTRANT ALSO ACKNOWLEDGES TO THE EXTENT PERMITTED BY LAW, ALL CLAIMS SUBMITTED TO ARBITRATION MUST BE BROUGHT SOLELY IN THE CLAIMANT'S INDIVIDUAL CAPACITY AND NOT IN A REPRESENTATIVE CAPACITY OR ON A CLASS, COLLECTIVE, OR GROUP BASIS (WHETHER OR NOT THE APPLICABLE RULES OF ARBITRATION WOULD OTHERWISE PERMIT ANY GROUP, CLASS, OR REPRESENTATIVE CLAIMS).

 

11. USE OF DATA. Sponsor will be collecting personal data about Entrants online, in accordance with its Privacy Notice. By participating in the Sweepstakes, Entrants hereby agree to Sponsor’s collection and usage of their personal information and acknowledge that they have read and accepted Sponsor’s Privacy Notice.  The Potential Finalist and guest will be transported from the Hotel Accommodation to the location of the Golf Shootout on 11/08, 2025. Spectators will be invited to watch the Golf Shootout. The rules of the Golf Shootout will be as follows: 1) Each Potential Finalist will be given one opportunity to hit a hole-in-one from a distance of 175 yards on a par three (3) golf hole specified by Sponsor; 2) The Tee area will be marked by Sponsor and the Potential Finalist may not take a shot from in front of the Tee area; 3) The hole-in-one must be accomplished as defined by the United States Golf Association Rules of Golf; 4) The Potential Finalist must wait until the Sponsor representative gives them approval to take their shot to allow for videotaping of the complete shot; and 5) the Potential Finalist must not play the hole the Golf Shootout takes place in the forty-eight (48) hours before the Golf Shootout.

If the Potential Finalist makes a hole-in-one pursuant to the above rules, the Potential Finalist will receive a prize of One Million and 00/100 US Dollars ($1,000,000.00) (the “Maximum Prize”). The Prize will be paid by Obsidian Specialty Insurance (“Insurer”) Company pursuant to its “Prize Award Installment Endorsement” which can be viewed here. Any action taken by the Potential Finalist that voids payment by Insurer will void Sponsor’s liability and/or obligation to the Potential Finalist in the event of a hole-in-one shot made. More than one Potential Finalist may win the Maximum Prize in the event of multiple hole-in-one shots made.

If there are no hole-in-one shots made by the Potential Finalists, the finalist with the shot that is closest to the pin, measured by distance from the final resting place of the Potential Finalist’s ball to the center of the hole, will win a prize of Five Thousand and 00/100 US Dollars ($5,000.00) (“Consolation Prize”). If more than one Finalist’s shots are an equal distance from the center of the hole, the winner of the Consolation Prize will be selected via flipping a coin.

Each Finalist and guest will be required to fill out a Waiver of Liability Form in substantially the same form as shown here: ___[insert link]___ (“Waiver of Liability”). Sponsor reserves its right to amend the Waiver of Liability prior to execution. Finalist and guest will be required to return a fully executed Waiver of Liability within seven (7) days of notification of their finalist drawing. If the Finalist is unable to attend on the dates specified herein, the Finalist may assign their participation in the Golf Shootout, and the finalist benefits set forth in this Paragraph 5, to another individual who is twenty-one (21) years of age or older as of June 1, 2025 (each an “Assignee”). A Finalist must notify Sponsor of the assignment within three (3) days of notification of their finalist drawing. The Assignee (and guest if applicable) will need to execute the Waiver of Liability within three (3) days of notification of the assignment. Any assignment must occur within seven (7) days of the Finalist’s notification of their finalist drawing.

Should a Finalist fail to respond to the Sponsor’s communications and attempts to obtain information and the Waiver of Liability within seven (7) days of the first attempted notification, or fail to reasonably respond to any requests for information thereafter, may result in the waiver of the Prize. In such event, Sponsor reserves the right to award an additional Prize to a new Potential Finalist

6. PRIZE RESTRICTIONS: Limit of one (1) prize per person/household. All prizes are non-transferable or assignable (except as set forth above) and no substitutions or cash redemptions; except at Sponsor’s sole discretion or as otherwise provided herein. Each Potential Finalist is solely responsible for all applicable federal, state and local taxes, including taxes imposed on their income. No more than the stated number of prizes set forth in these Official Rules will be awarded. Potential prize winners consent to the use of their name, likeness, biographical information, and voice in advertising worldwide without additional compensation.  A POTENTIAL FINALIST MAY NOT BE ANY PERSON THAT HAS PLAYED IN A PROFESSIONAL GOLF TOURNAMENT IN THE LAST 24 MONTHS.

 

7. NOTIFICATIONS/CLAIMS.

 

GRAND PRIZE:

Potential Finalists will be notified by the Sponsor by email and/or phone on or about September 8th, 2025 (the “Notification”). Grand Prize winners must respond to Notification within three (3) business days of the Notification. In the event the Potential Finalist fails to respond to the Notification within three (3) business days of the Notification or if it is determined by Sponsor, in their sole discretion, that a Potential Finalist is not eligible in accordance with these Official Rules, an alternate Potential Finalist will be selected at random from among the remaining non-winning eligible entries received during the Sweepstakes Period for the specific state the prior ineligible Potential Finalist was selected. The Potential Finalist will be required to sign and return (except where prohibited) an Affidavit of Eligibility and Waiver/Publicity Release and a W-9 tax form (the “Paperwork”) within ten (10) days of the Notification. After verification of the Affidavit, the Sponsor representative will contact the Potential Finalist to book travel as set forth above. Potential Finalists must return the Paperwork within the date and time indicated in the Notification. The Potential Finalist also must provide such information that is necessary to book air travel and accommodations. If a Potential Finalist fails to return the Paperwork within the date and time indicated in the Notification, or is found to be ineligible, or if they do not comply with the Official Rules, such Potential Finalist and their entry will be disqualified and another Potential Finalist will be selected from the remaining eligible entries received. If the Notification is returned as undeliverable, this will result in disqualification and an alternate Potential Finalist will be selected from the remaining eligible entries in the state the prior Potential Finalist was selected from.

 

The value associated with the Prize is taxable as income and each Potential Finalist is solely responsible for any taxes, including, but not limited to all applicable federal, state and local taxes that become due with respect to the value of the Prize. The Sponsor must report the value of the Prize to the Internal Revenue Service in the year the Prize is received by the Potential Finalist and will be reported to the Potential Finalist and the Internal Revenue Service in the form of a Form 1099.

 

No compensation will be provided for any prizes that are not able to be awarded to a prize winner.

 

8. CONDITIONS. This Sweepstakes is conducted in English. In the event of any discrepancy or inconsistency between the terms and conditions of these English Official Rules or other statements contained in any Sweepstakes-related materials, including, but not limited to: any entry form, and/or point of sale, television, print or online advertising; the terms and conditions of these English Official Rules shall prevail, govern and control.

All federal, state and local taxes are the sole responsibility of the Potential Finalists. By participating in this Sweepstakes, Entrants and prize winners agree to be bound by these Official Rules and the decisions of the Sponsor and Sweepstakes Entities, which are final in all respects and not subject to appeal. Notwithstanding the foregoing, the Sponsor reserves the right to amend, update, change, or modify these rules as set forth herein, but also for technical, logistical, or other reasons necessary to conduct the Sweepstakes in the manner intended by the Sponsor.  

Sponsor reserves the right to disqualify permanently from this Sweepstakes any Entrant it believes has violated these Official Rules and verify eligibility of Entrants. Neither Sponsor nor anyone acting on its behalf will enter into any communications with any Entrant regarding this Sweepstakes, except as expressly set forth in these Official Rules. By participating in this Sweepstakes, Entrants, and Potential Finalists release the Sponsor and each and all of the Sweepstakes Entities, from any and all liability, damages or causes of action (however named or described) with respect to or arising out of participation in the Sweepstakes, and/or the receipt or use/misuse of any prize awarded, including, without limitation, liability for personal injury, death or property damage. Failure to comply with these Official Rules may result in disqualification from the Sweepstakes.

All Sweepstakes materials are subject to verification and are void if (a) not obtained in accordance with these Official Rules and through legitimate channels, (b) any part is counterfeited, altered, defective, damaged, illegible, reproduced, tampered with, mutilated or irregular in any way, (c) are obtained where prohibited, or (d) they contain printing, typographical, mechanical, or other errors. Entrants assume all risk of loss, damage, destruction, delay or misdirection of Sweepstakes materials submitted to Sponsor. In the event any portion of this Sweepstakes is compromised by activities beyond the control of the Sponsor which, in the sole opinion of the Sponsor, corrupt or impair the administration, security, fairness or proper play of the Sweepstakes or this Sweepstakes, Sponsor reserves the right at its sole discretion to modify, suspend or terminate the Sweepstakes.

Winning a prize constitutes permission for Sponsor and its agencies to use prize winners' names, addresses (city & state), voices and/or likenesses for purposes of advertising, promotion and publicity, for this Sweepstakes only, without further compensation, unless prohibited by law. Sponsor may prohibit an Entrant from participating in the Sweepstakes or winning a prize if, in its sole discretion, it determines that said Entrant is attempting to undermine the legitimate operation of the Sweepstakes by cheating, deception, or other unfair playing practices (including the use of automated quick entry programs) or intending to annoy, abuse, threaten or harass any other Entrants, Sponsor, or Sweepstakes Entities.

If for any reason this Sweepstakes is not able to be conducted as planned, including, but not limited to, by reason of infection by computer virus, bugs, tampering, unauthorized intervention, fraud or any other causes beyond the reasonable control of Sponsor which corrupt or affect the administration, security, fairness, integrity or proper conduct of the Sweepstakes, then Sponsor reserves the right at its sole discretion to cancel, terminate, modify or suspend the Sweepstakes and randomly draw from those entries received up to the cancellation/suspension date to award prizes. CAUTION: ANY ATTEMPT BY A PERSON TO DELIBERATELY DAMAGE OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES MAY BE IN VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK REMEDIES AND DAMAGES (INCLUDING ATTORNEY’S FEES) FROM ANY SUCH PERSON TO THE FULLEST EXTENT OF THE LAW, INCLUDING CRIMINAL PROSECUTION. SPONSOR’S FAILURE TO ENFORCE ANY TERM OF THESE OFFICIAL RULES SHALL NOT CONSTITUTE A WAIVER OF THESE PROVISIONS.

 

9. NO LIABILITY: By participating, Entrants and prize winners agree to release, discharge, indemnify and hold harmless the Sponsor, the Sweepstakes Entities, and each of their respective officers, directors, employees, representatives and agents (collectively, the “Released Parties”) from and against any claims made by any Entrant, prize winner, or any other third parties, related in any way to the operation of this Sweepstakes as well as any other claims, damages or liability due to any injuries, damages or losses to any person (including death) or property of any kind resulting in whole or in part, directly or indirectly, from receipt, acceptance, possession, misuse or use of a prize or participation in any promotion related activity or participation in this Sweepstakes.

 

10. ARBITRATION, GOVERNING LAW, AND WAIVER OF JURY TRIAL AND CLASS ACTION. This Sweepstakes shall be governed by and interpreted in accordance with the laws of the State of Arizona, without giving effect to the principles of conflicts of law of such state. Except where prohibited by law, Entrants and Potential Finalists agree that: (a) any and all disputes, claims and causes of action arising out of or connected with this Sweepstakes and the Official Rules shall be resolved individually, without resort to any form of class action; (b) any and all disputes, claims and causes of action arising out of or connected with this Sweepstakes must be submitted to binding arbitration under the rules of the American Arbitration Association, with one (1) arbitrator selected in accordance with such rules, or by the mutual selection of the Sponsor, or its affiliated entities, and Entrant or Potential Finalist, with the arbitration hearing to take place in Phoenix, Arizona; (c) The prevailing party to the arbitration may enter any final arbitration judgment in any court having jurisdiction thereof; and (d) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Sweepstakes, but in no event attorneys’ or experts’ fees.

 

EACH ENTRANT ACKNOWLEDGES AND AGREE THAT BY PARTICIPATING IN THIS SWEEPSTAKES, THEY ARE KNOWINGLY AND VOLUNTARILY WAIVING ANY RIGHT TO A JURY TRIAL FOR ANY DISPUTE ARISING OUT OF THIS SWEEPSTAKES. EACH ENTRANT ALSO ACKNOWLEDGES TO THE EXTENT PERMITTED BY LAW, ALL CLAIMS SUBMITTED TO ARBITRATION MUST BE BROUGHT SOLELY IN THE CLAIMANT'S INDIVIDUAL CAPACITY AND NOT IN A REPRESENTATIVE CAPACITY OR ON A CLASS, COLLECTIVE, OR GROUP BASIS (WHETHER OR NOT THE APPLICABLE RULES OF ARBITRATION WOULD OTHERWISE PERMIT ANY GROUP, CLASS, OR REPRESENTATIVE CLAIMS).

 

11. USE OF DATA. Sponsor will be collecting personal data about Entrants online, in accordance with its Privacy Notice. By participating in the Sweepstakes, Entrants hereby agree to Sponsor’s collection and usage of their personal information and acknowledge that they have read and accepted Sponsor’s Privacy Notice. By law, winners’ names may be required to be advertised to the public.
